Many of us have already written a Will, but it’s important to regularly review it as a change to your family structure, a house move or a decision to pledge a legacy gift to charity all might mean your Will needs to be updated. With this in mind, Cancer Research UK Legacy Management Officer Chloe Fairbrother, and WBW Solicitors Partner, Catherine Causey, are here to answer your questions on writing or updating your Will.

As a Legacy Management Officer at Cancer Research UK, Chloe is responsible for ensuring that our supporters' generous legacy gifts are received in accordance with the wishes in their Will. She supports executors to administer an estate, ensuring gifts in Wills go on to fund a third of Cancer Research UK’s life-saving research.

Catherine Causey
Catherine Causey qualified as a Solicitor in 2005, and specialises in all aspects of private client work. She is now a Partner and head of the private client department at WBW Solicitors – one of Cancer Research UK’s trusted legal partners offering advice via the Free Will Service.

I have made a will which is simple and divides everything ( if anything left !) between 2 people.

I'm now beginning to worry about one of these people in terms of their mental health. I'm wondering if I should somehow stipulate that the other beneficiary should be given Power of Attorney to make sure any money is used wisely. Obviously they would have to agree to take on this responsibility..

I used one of these charity 'will months' to make the will - can't remember exactly which charity, so paid approx £100.

How much would it cost to change my will and add this condition regarding one beneficiary? And could it be done through one of these charity schemes or would I have to pay the full price?

I hope I've made this clear. I'm trying to avoid any possibility of identification.

We made wills 30 years ago not long after we got married (second time for both) and agreed 50/50 split with everything going to children from recent marriages. I would like to to make new wills and have everything split equally between the 3 children but I think my OH wants to leave it as it is i.e. his daughter gets half and so my 2 get a quarter each? What do you think? We've always treated them equally up to now so why not when we die?

If we decided to update our will, would it be as expensive as writing a new will, or less costly?

In Scotland children are entitled to claim a percentage of movable estate.

What counts as moveable estate?

Can a policy (insurance) be “willed” to someone for a specified use or must it be cashed and become part of the moveable estate?

My wife and I have updated our mirror wills fairly recently but what we really need to knuckle down to is to create a Lasting Power of Attorney (LPA) for each of us so that, should we become mentally or physically incapacitated in some way, the other partner or our children will have such power to make sure our affairs are ordered as we would wish. We got a solicitor to do the LPA for my wife's father which has proved very useful now he is becoming more and more restricted in what he can do both physically and mentally. We are minded to use the online Government site to try to do our LPAs ourselves, using his LPA as a model. Are there any serious downsides to doing that?

I have a certain amount of money to leave to my grandchildren. As there may well be more grandchildren can i just specify the money is to be equally split rather than updating every time

We have recently discovered that the solicitor who was holding our will has gone out of business. We were not notified and have no idea where the original will is. We have copies. Are these still valid? We also need to make changes so I am assuming we find another solicitor. Will it cost less than the original to make changes.

If you move into a parents house to care for the parent in their twilight years, and there is no will, would another sibling be able to force you to leave the house in order to sell it or would you have any rights in order to be able to stay in the house and continue living in it as your home?

My elderly parents own a property in Spain as well as a property in England.

I do have a will here in the UK, but wonder if I need to do anything different with my will because of the Spanish property, should they pass away? I have 2 brothers and the estate will be a 3 way split. Thanks.
