Attendance Allowance.

I'm posting here because Im angry
My husband has cancer of the oesophagus and has liver mets.
He has less than 2years to live but has been refused AA because he doesn't need constant attendance during the night.
It's their rules I guess...but gid..am I angry..

You can also get help from Macmillan ask if they have a Welfare rights officer in your area. Always get help from a professional to fill in forms like this as they know what to say .

Fidelity there are now certain conditions such as deafness and Macular Degeneration which almost rubber stamps it. I added extras which were true but gave them a better idea of how I coped at home. I use a stairlift and also because of the Macular Degeneration, I have mega problems fitting a plug into a socket. I had to get my bath removed and I now have a lovely shower but for extra safety, I have an adjustable stool. I think going into detail helped me.

I have recently been turned down for Attendance Allowance too. Apparently they contact one's doctor who gives his,or her opinion as to your condition and abilities.

There are many equalities in being given AA.
I know this from personal experience.
My H who had Alzheimer’s, had a major stroke and AF , couldn’t be left alone for any length of time was turned down the first time but I was encouraged to apply again and he was granted it.
A friend who applied for a Blue badge was turned down for that was told to try for AA instead and got it straight away.
He led a very busy and totally normal lifestyle even in his own opinion.
Finally a neighbour had an appointment last week to see if she was entitled to pension credit, she wasn’t as her savings precluded her but because she used a Walker to the appointment, she doesn’t usually,was told to apply for AA.
I wait to see if she gets it.

Update.
Apologies to Bonnybanko..we missed each others calls.
Anyway ...I wrote the DPW and said that since the arrival of the letter dissalowing our claim
I explained things had changed etc .
And we received the letter confirming that we were granted the higher rate.
Following this we had a call from a very nice lady at the DWP.sayingvthst we should have been granted it after the first claim and it had been a mistake to not grant it.
We are grateful for the help. Things are not good for my lovely husband. The cancer has spread and are priority is to spend as much time as we can together with the family.

I would write back and question that. I filled in those applications a few years ago for my father and for my next door neighbour. In both cases they received the benefit. I don’t recall being asked if they needed constant attention through the night. I am sure your poor husband needs attention in the day and someone on hand for any problems at night. I remember my elderly vulnerable mother who had had a heart attack and was partially sighted applying for it. It was refused and she wrote back and questioned the decision stating that she knew people who were in a far better state than herself who were getting it. They wrote back granting it. Perhaps in some cases they await a challenge and challenge I would definitely do. Also emphasise the state of his illness- spell it out.

I received the higher rate a few days ago. I filled in the form the same way as I did for the Blue Badge. There is a certain way of doing it and I was lucky although I do not need physical help.

I think my form was rubber-stamped because I received notification in 6 rather than 12 weeks.

You are right Visgirl Attendabce Allowance and DLA were over lapping and cancelling out benefits. DLA was granted to working people butcarried on through retirement. AA is only for those who become disabled after theyhave retired. Now, of course, it is PIP, not DLA.

Sago It wasn't a separate benfit, but a fast track to get DLA or AA. You got a letter from the consultant and the grant was immediate.

I too was going to say Age Concern will help you fill in the form, you should get it?
My Dad didn't get it as he already had a disability allowance, not sure if that changed but you don't or didn't get both.

CAN were brilliant. I applied on behalf of my mother and got the lower rate. Went to CAB and they helped me appeal not the decision but the rate. She then got the higher rate.

I’m so sorry to hear about your husband. He should be entitled to receive the lower rate. It’s lovely that other posters have offered to help. Please don’t give up, your husband deserves the extra help.

You can appeal if this is recent. You need to start the process by requesting a “mandatory reconsideration”, then you can move to full blown appeal.

Definitely try again with the help of one of the mentioned agencies. RNIB helped me with Mum's form. She was exhausted at the end but it was worth it.

It's so lovely that members have offered to help here. I found it a nightmare trying to complete the forms on behalf of my in-laws, and I'm no stranger to dealing with similar paperwork. Hope you get the help your husband so clearly deserves.
