Mobility car

If they get found out the car will be taken away and they won’t be able to apply for another. Quite rightly.

My son in law’s mother has just been awarded higher rate mobility and is looking at getting a car.
She wishes to name my son in law and daughter as named drivers on the car as she herself doesn't drive.
She is under the illusion that they can sell their car as they will no longer need it, as they will have full use of her mobility car, to go to work pick the children up from school etc.
correct me if i am wrong but doesn't the journey in the car have to be for the benefit of the disabled person not the driver.
My son in law’s mother insists i am wrong, i really do not want them to get into trouble over this.
If i am right how can i convince her?

You are correct...that said, lots of people do it the way your family are suggesting ....personally, I wouldnt get involved

My daughter-in-law has terminal cancer and has been awarded PIP including the mobility allowance. She has looked into getting a mobility car but would have to give up quite a large part of her mobility allowance. You can nominate three named drivers but it must be used for the person it is intended for so if our son was nominated he wouldn’t have been able to go to work in it in case something happened to our DIL and the car was needed. It would have been more beneficial to nominate her sister who doesn’t work and does the majority of the caring for our DIL. Servicing, tax, insurance and tyres are included. It would probably work better for a retired couple.

The car must be used by the disabled person or for their benefit, so the car cannot be used by your son in law and his wife as you describe. Show her this
