Questions re writing a will

If have written a letter of intent to my two adult children expressing my wishes but at the end of the day it is up to them what they do. They can follow my wishes or ignore them, they can administer the trust or close it and distribute the money according to my will.

But I discussed my reasons for the trust with my two adult children who are the executors and also with my other adult child who is the reason why I have set up a trust. They are all aware and agree with my reasoning and I trust them implicitly. I would not have set up a trust in secret without their agreement.

I am not a lawyer but I have read that a beneficiary has the right to inherit their trust fund at the age of 18, whatever is written in the will. Worth checking that out.

Only one way to sort these kinds of questions out. Speak to a solicitor.

One can be answered. Solicitors usually charge a percentage of the estate for acting as executors. 1 or 2 % depending on the size of the estate.

If you have 3 questions today, by the time you write the Will I expect you will have more, you really need to see a Solicitor .

Re stating what trust can be used for, I think we’ve left a letter of wishes ( I think it’s called) where we’ve said what we’d like the trustees to pay out for - we’ve mentioned property and education/training.But really choosing the right trustees is what really matters

Re age - I don’t believe there’s a maximum - with our dgs we went for 30 before the trust would be wound up.

Questions re trusts need a good solicitor experienced in that work.
As for using solicitors as executors - they are expensive but may be advisable if trusts etc are involved. I believe it’s usually a % of the value of the estate.
