If the appeal fails the visa will be cancelled for 3 years. Wonderful. The Aussies are to be applauded for applying the rules across the board. UK can take some lessons from them.

The Aussies have IMO handled this woefully badly.

I believe the case is to be heard by a team of 3 judges, not just the one.

This is correct. The hearing will be held in a Full Court of the Federal Court of Australia comprised of a panel of 3 judges.

This is a final decision there is no room for appeal by either side after this.

Messy process but absolutely the right thing to do to not allow him entry. Also quite horrified by his behaviour (attending public events) when he was positive.
I understand that you have to be incredibly single minded and perhaps selfish to achieve the levels of sporting brilliance that he has, but he needs to step out of that bubble now. Accept he was in the wrong, stop fighting the visa issue and just quietly go home. Show some genuine contrition and he might salvage things. But if he carries on fighting this he will lose a huge part of his fan base. And that might matter to him more than he realises..?

Hooray. But I fear that there is probably a lot of pressure on the government from the Tennis authorities who know they will lose oodles of money if he doesn't play in the tournament .

I have no sympathy with anyone here, as I simply do not understand why major sporting events are being held during a pandemic.

As far back as October 2021 Djokovic was expressing concern at having to quarantine for two weeks on entering Australia, because he is unvaccinated, so I think this has all been an attempt to circumvent that process.

The first visa cancellation was quashed because of immigration officials’ procedural mistakes, but this time the matter will be heard in Federal court, so I think he’s in for a hard time. The exemption certificate was issued by Tennis Australia with the backing of the Victorian state government - not the Federal Government, which has the last word on who goes and who stays. It was issued on the grounds that he’d already had Covid, but apparently he had already been made aware that that wasn’t a valid reason for exemption. Add to that his vocal opposition to the vaccine and the fact that he’s been proved to have flouted quarantine laws while Covid positive, and a picture emerges of a man who assumes massive privilege.

The Federal Government is now seeking cancellation of his visa on health and good order grounds, on the basis that it was in the public interest to do so. I hope they succeed because someone needs to impress on this arrogant man that just because he’s wonderful at tennis, it doesn’t mean he can ride roughshod over millions of Australians who have endured real hardship during the pandemic. A lot of people have died. he needs to be respectful of that and get things into perspective.

Yes they did have a two week quarantine.

What annoys me more is the fact that he supposedly tested positive for Covid then mixed with a lot of other people and got away with ignoring rules then, presumably spreading the virus to man people.

I don’t think it makes the Aussie Government look bad. Get rid of him. These spoilt kids get on my nerves. Our Government with the highest death rate in Europe should have taken lessons.

I do not hve not have an issue with this.
- Not vaccinated
- Broke isolation when he is supposed to have tested positive
- Incorrect information on his visa.
Alo don't think it's an issue the same judge is hearing it - the previous decision was based on procedural issue not the merits of him being allowed into he country or not.

Good on Australia! @Spice101 I think the world can see that the Australians are happy to stand up for their principles. I certainly don’t think it puts the country in a bad light - quite the opposite! I wish our UK government didn’t give in to the rich and famous rather than take the high ground and stick up for rights and principals!

He should be deported for a variety of reasons - lying on original visa, attending public events whilst testing positive, for going to Spain but saying he hadn’t travelled anywhere. Arrogant. Full of own self importance. No sympathy for him.
