Hypothetically, if these 2 were officially charged, could they take a plea deal to avoid a trial?

No we don’t have plea deals. Pleading guilty can betaken into account when the sentence is decided

If they pleaded guilty there would not be a trial though just a sentencing I presume, the same as for other people?

I knew absolutely it would end in disaster but even I am quite astounded at the scale of the disaster.

Yes that’s right - just the sentencing hearing but no pleas deals.

Probably PM will be treated like AMW After being arrested and uestioned, he will, like AMW, be released under investigation – meaning not being put on bail after his release, and therefore his release is not subject to any conditions. That's not to say that both of them will not be e-interviewed HBoth can be rearrested or asked for follow-up interviews at any time.

That’s ok Iam64, these are exciting times, even if for all the wrong reasons.

What concerns me is, with everything being made so public, both his and Andrew’s lawyers are likely to say that they cannot have a fair trial so they will both get off.

We hardly know it all yet, and I'm convinced Trump and other very powerful people in the US and maybe other countries were involved but we may never know - probably until it comes out years later. I also think part of his quite evil gifts were to compartmentalise - so that the gourd of people A,B,C didn't know what he was up to with other connections.

I don’t it necessarily means that. - I thought the main difference was with bail, there will be a date when you have to return to the police station. In A’s case, no date given.

It seems police arrived at Mandelson’s home after 4pm. Usually they arrive in the morning . Did something happen to get them out late afternoon?

Well maybe but it could have simply been something else cropped up earlier in the day and they had to deal with that first. It doesn’t really matter does it? I’m just really pleased that both men have been arrested and are being investigated. For too long the rich/ powerful/ well connected have been treated differently by our CJS . Let’s hope this signals a real shift ( not holding my breath)

Reporting to a police station, is only one of the conditions of bail. The reason bail is imposed will because of perceived risk.

Well maybe but it could have simply been something else cropped up earlier in the day and they had to deal with that first most unlikely, there aren't just one or two officers dealing with this. If they'd intended an early morning arrest they'd have done an early morning arrest. Something tipped the balance for them to arrest late afternoon rather than waiting until the next morning.

Well we don’t know do we but quite honestly does it really matter ? The next thing that matters is if they decide to charge or not.

Lemon jam can you help on if it’s true that bail is imposed because of perceived risk instead of released under investigation ( no risk)? I didn’t think so but it would be helpful to know what you say is the difference

The charge is very vague, and as I understand it there are few, if any, precedents to fall back on for sentencing guidelines, so a lot will come down to discretion. I know the maximum sentence is life imprisonment (at His Majesty's pleasure, no less), but 'misconduct' covers a multitude of sins.

I wonder what's coming next.

As far as I'm concerned, Mandelson had greater power than anyone else, as regarding the State.

What is common law?

Keeping quiet - I think the coming law reference is to the fact that misconduct in public office is a crime under common law not statute. Doesn’t make a difference to trial.
