employment tribunal

has anyone made an application to an employment tribunal? Do you know if applications are usually accepted as long as the grounds are reasonable. Do we put just basic outline on the initial application or do we have to give the full story and supporting evidence? many thanks

Hi Messenger I did not find ACAS very helpful and to be honest once things hotted up they backed out. I suspect their role is to try and dissuade people from going to tribunal to save money. Thanks for the good wishes everyone . We go to the oral hearing in May so will let you know the outcome.

Hi Seasider....extremely sorry you lost your case at ET...but now it`s over.. what I would be interested to know is...where were your friends at ACAS their representation for you....NEVER trust ACAS...employers friends..I am STILL[angry[at ACAS so called representation in my case...I would like to take ACAS on.

Hi Seasider....yes I can offer some advice..especially about ACAS...beware of ACAS....I lost a considerable amount of money because of the inneficient way that my adviser behaved. Because my case was scheduled befrore the `bank` holiday the adviser said that she could not get in touch with me..because telephones were not invented in 2009 or computers or Royal Mail or any other means of communication and as always these organisations watch each others backs...don`t trusat ACAS[ANGRY]

seasider I know it's hard to persist, but I do admire you for it - even if you don't get the outcome you'd like and deserve I still think that for the sake of the principle you're right to keep on rattling the cage. [medal emoticon]

Thanks everybody I do feel much less stressed about the whole scenario now , probably because DP has a job until at least the end of March. The oral hearing will be as far as we can take the process I think but i just feel we have to try, so fingers crossed. I actually ran into DP's ex-manager ( and supposed friend), who instigated all this trouble, just before Christmas. It was perhaps as well I was volunteering at a charity fundraiser or I could not have been responsible for my actions!!

I've been following your story, seasider, and am impressed by your perseverance! Most would have given up long ago - I do hope you get the result you want from the hearing, you and your DP certainly deserve it.

to anyone following our employment tribunal saga we have now been granted an oral hearing in London on 1st May 2013 . Hopeully this judge will be able to see how badly DP was treated and how he was set up by his manager. I think this is as far as we can go but whatever the outcome at least we will have explored all the options .

I am sure there are those who will think we are mad to carry on but I have today submitted our appeal to the Employment Tribunal. I just feel we have to try. On a positive note DP, who is actually enjoying his current( no responsibility) job, has got another slightly more permanent post wich will take him through to next year. smile

I wish I could Merlotgran I would love to walk away but I hate unfairness and I truly believe DP was forced out. It is a case of an individual against a national company and I feel we must persue it as far as we can for ourselves and future employees who may be treated as badly. The company concerned promotes themself as a hapy clappy family friendly company . If only people knew the underhand practices that go on! Thanks for your concernx

Don't put yourselves under any more stress, seasider. Accept and move on. Some things are meant to be and your DP sounds like he's enjoying his new job. When my DH was made redundant from farm management he went lorry driving for a few years to take him up to retirement. He loved the lack of responsibility even though the money wasn't good and it meant I had to carry on working past retirement age. We got here in the end though. smile

Hi all . The review has been refused but I don't suppose any judge is going to overturn their own decision!. They have agreed to provide a full statement of reasons for the original decision so we then have to see if we have grounds for an appeal. On a positive note Dp's new job is physically taxing and poorly paid but I think he is quite enjoying the lack of responsibility. It has also made him realise just how bad the atmosphere was at his previous place of employment and the stress everyone was under. Thanks again for all your support smile

You have nothing to lose by asking for a review do you? I think it is very brave of you after such an unpleasant experience, but give it a go!
