Theres a whole list of Tory MP's and councillors who have been charged with sexual offences ,Mr Francois is only one of a number who appear to have been kept well out of the limelight by the government.the list is available online.I ant copy and paste as my laptop is playing up and I cant be bothered typing it out...its quite a lot

Who cares where Mark Gino Francois is? Where's Guy Fawkes when you need him?

growstuff Mon 26-Oct-20 22:59:03

Apparently, the Tory MP accused of rape and assault had his bail lifted at his hearing last week.

I've seen him a couple of times lately in his constituency. He's certainly not hiding.

So why has he been allowed to vote by proxy?

Well biba as my dm would have said’ I’ll believe you, thousands wouldn’t’ 😀

ah- it was actually a video from that popped up on my timeline elsewhere- a spoof video of Johnson, Rees-Mogg and Mark Francois- honest. Just can't copy it for some reason- but this is what triggered my question.

Don’t know grow my guess is that the police are waiting on the CPS decision re charging. Wouldn’t like to be the PP having to making that decision

Tempting to reply “Good riddance to bad rubbish”

Thank you. Very helpful. Now I understand (I think).

I also understand the reference to the extension of the bail date.

Does "bail to return" mean that he will have to return to the police station and possibly face more questioning?

suziewoozie Mon 26-Oct-20 18:03:39

This is clear and helpful

Aha! So at what point is a person actually charged?

Is it normal to set bail without charging somebody?

growstuff Mon 26-Oct-20 18:01:42

*A Conservative MP accused of rape has had his bail date extended until November as a police investigation continues.

The change has raised questions over whether the former minister, in his 50s, will return to parliament when it returns from summer recess in two weeks.

The Conservative Party has been criticised for refusing to suspend the MP, after initially being approached by the complainant in April.

The man was arrested on 1 August after the police received allegations of rape and sexual assault in four separate incidents.

They are alleged to have occurred at locations in Westminster, Lambeth and Hackney between July 2019 and January this year.

*A spokesperson for the Metropolitan Police said: “A man in his 50s was arrested on 1 August on suspicion of rape, sexual assaults by penetration and touching and assault.

“His bail to return date has been extended to early November 2020. The investigation is being undertaken by the Met Central Specialist Crime, Complex Case Team.”

The man has not been officially identified and Scotland Yard said it could not give details of his bail conditions.*

That's still on the Independent website (and other places), so I assume it's OK to copy.

I'm afraid I don't know enough about the law to know at what point somebody is actually charged.

What does "setting bail" involve? Whoever it is has had a "bail date" set for the middle of November. Doesn't somebody have to be charged before bail can be set?

Riverwalk Mon 26-Oct-20 17:41:21

As far as I understand things, an MP has NOT been charged and the police are investigating an accusation.

If any MP is charged with rape it will be headline news and he will be named.

suziewoozie Mon 26-Oct-20 17:38:20

I’m absolutely sure he has not been charged - absolutely

growstuff Mon 26-Oct-20 17:36:55

Maybe somebody who knows about the niceties of legal proceedings could enlighten me.

I thought this unknown person has been charged, but no date has yet been set for trial.

Generally, the public is asked not to speculate before the end of the trial because it could prejudice the outcome. However, names are usually released after somebody has been charged.

Or have I got this all wrong?

suziewoozie Mon 26-Oct-20 17:25:08

The public who want to know do know or can easily find out. Before someone is actually charged, then anonymity is generally the right action so long as safeguarding/ protecting others potentially at risk and/or protecting as necessary the alleged victim/s is taken into account

biba70 Mon 26-Oct-20 16:43:21

I'm not 100% sure, but I think the unnamed MP has been charged, but not prosecuted.

Should the public not know about these things? Somehow?

paddyanne Mon 26-Oct-20 16:41:29

I was very angry that he was allowed to vote by proxy when Amy Callaghan wasn't ...she isn't facing criminal charges ,shes recovering from a stroke which almost claimed her life in July..I guess its just one rule for them and another for us

vegansrock Mon 26-Oct-20 16:36:13

OK arrested on suspicion of rape and bailed. Anyone know who that is?

Riverwalk Mon 26-Oct-20 16:33:25

I didn't miss anything - he has been accused not charged.

growstuff Mon 26-Oct-20 16:32:28

No MP has been charged with rape, as far as I know.

One has been accused and a bail date set for mid November, but nobody's allowed to talk about it.

You obviously missed this buried news story riverwalk
