Delayed flight

Recently our trip from Nice to Edinburgh we believe was delayed at take off by 3hrs and 15minutes only to be told by the airline in question that it was delayed by 3hrs and 3 minutes. The airline say our arrival was only 2hrs and 15 minutes and we're not eligible for reimbursement. We're not even going to receive our extra fuel costs because we don't have a receipt. I'm so scunnered by the run around and will think twice about flying with this airline again. Has anyone got any advice on this matter it would be much appreciated. angry

When I went to India last year the return flight was delayed overnight due to a faulty windscreen so I claimed under the EU Directive page on Virgin's website and got the maximum refund of about £430. In addition to overnight hotel, food, transport etc.

If you have a look at this Martin Lewis article, you see that the three-hour thing is crucial as that's the minimum length of time for a late arrival, before you can claim. Scroll down to the rules for claiming, No. 4: it's not the length of delay to take-off but the delay in landing that counts.

So if you're late taking off but land only 2 hours & 55 minutes late you can't claim.

Also in this article is a website called FlightStats which seems to give stats on flight times/arrivals so you maybe able to ascertain exactly how late you arrived.

It's all in the wording Riverwalk the airline doesn't say delayed in arriving it only says flight delayed. Ambiguous at the least and I'm still scunnered. What do you think about my claim for fuel. My brother had to drive from his home to pick up my car which was in the Park and Ride because the Park and Ride would have been closed. He then had to get his wife to take my car home and return later to collect us from the airport. I don't think it's unreasonable to ask for the additional fuel costs which we used in order to get home. Should have got a taxi that would have sorted them out,

A couple of years ago our flight to Barcelona was delayed by 11 hours. We had to spend a whole night at the airport. Noone provided us with extra night at hotels or even food. We wrote a claim but without any results. As far as I know it is useless to submit such cases to court. Just a waste of time.
