Child Custody dilemma

My 10 year old Grand daughter was illegally abducted by her father and taken to Malta two years ago and none of her loving family in England have seen her since. Her father has told lies to the court and to the child, leading her to believe that her mother and her family no longer love her and that we are dangerous! The judge in Malta has recently overruled several court decisions that the child was to return to England to her mother who loves her so much and misses her as we all do. She has siblings here who have not had meaningful contact in two years. The judge made his decision for her to stay in Malta after speaking to the child who said that she wants to stay. She has based her decision on her mistaken belief that no one loves her in England. We have only two days to submit an appeal. If her father gets his way, we will never see our child again. We have no address or contact and her father has severed all links. This is so cruel that the justice system can work in this way and be so oblivious to the truth. The Maltese press is presenting a completely biased picture showing that the child has a new family and a new Mummy! She has no need for us in England!
I feel helpless!

Can any member of the family get to the court to speak at the hearing Daina? The UK has a good relationship with Malta and I would imagine a solicitor could speak to a proxy over there to act on your behalf?

I guess the only comfort is the fact that she seems to have settled well in Malta.

Surely her Mum will be awarded visitation rights. confused

Daina that is terrible; I can't imagine what you must be going through. I think when has made a good suggestion, and I also hope that you have good legal representation from an expert in these matters. I only hope you will have time to get the appeal in. Good luck x

Daina Are the Embassy doing anything to help they are very good at times like this they where excellent when my DD had to get her boys out of Portugal before their father had time to get to family court to claim they stayed with him,they may be able to as when has said get someone to take your case to the judge who is dealing with the case,I for the life of me cannot understand any judge doing this as a child of 5 yrs without giving the family time to give their objections,cruel very cruel.Good luck

Sadly this little girl has had two years now to settle down and develop bonds with the family in Malta. She will have formed attachments to her current carers and at such a young age will undoubtedly be inclined to believe what the adults in her life have told her. It is unlikely that there can be a happy outcome to this case as even if your GD comes back to the UK she is likely to be distrustful and hurt. Even so, it's important to take whatever advice the legal professionals are offering and submit an appeal. In the future your GD can be told that she was loved and fought for. sad

THank you grannyactivist. Sadly you are right in that she has settled. He was banking on that when he was playing for time with the courts. We have to keep trying tho just to show her she is loved, if we ever get the opportunity. my oldest granddaughter has submitted quite a heart rending letter to the court. She and her brother have done nothing wrong. They miss their sister terribly and i am sure she must miss them

I believe my daughter has a legal team acting on her behalf over there. We have all submitted letters to the court but have not been able to appear personally.

Glammanana - I am confused as to what the Embassy do! We were about to speak with the High commission in Malta last time we were there but we were too late as his appeal beat us to it! - Is the High commission different to the Embassy?
I don't know if there is anything to be gained by speaking with them in the meantime.
