Fraudulent referendum

Last December, it was reported that- the “corrupt and illegal practices” of the Vote Leave campaign in the 2016 referendum undermine the validity of the decision to leave the EU, the high court has been told.

Relying on findings made by the Electoral Commission about overspending by the pro-Brexit campaign, British people living in Europe have launched a legal case arguing the referendum result should in effect be set aside.

“Breaches of spending rules are serious offences that vitiate the referendum result,” Jessica Simor QC, for the claimants, told the court. “Corruption and illegality in the course of an election or referendum must have a consequence. Corruption and illegal practices undermine the rule of law and democracy.”

There was significant overspending, data breaches and possibly Russian involvement in the referendum, she said. “The electorate can no longer be expected to respect the result.”

Today we learn that the information commissioner has launched an audit into Leave.EU and the insurance company owned by the campaign’s key financial backer, Arron Banks, after fining the organisations a total of £120,000 for data protection violations during the EU referendum campaign

Why has this taken so long to investigate ? That fraudulent referendum should be declared invalid and Article 50 should immediately be revoked.

Mrspn19469 - yet another Leaver who conveniently forgets the 16.4 million who voted to Remain. Before joining the EU we were known as the poor man of Europe, but between joining and 2014 our our GDP per capita had grown by 109%. The highest in the EU.

None of you have explained why it is a good idea to leave apart from feelings and beliefs and yet you decry those of us who do try to present information.

I have to repeat, for Mrspn19469 - democracy requires the consent of the loser. By querying "how the democratic vote of 17.4 million for leave, the biggest vote ever in this country is being ignored by the London centric political elite" the poster seems to show they are unaware that both winners and losers of elections have responsibilities in a democracy. Winners should not abuse the law or fight on false information and losers should not refuse to accept the results of a vote judged free and fair.

This election has been judged, in so many ways, not a fair one. That is why people do not accept it as a "win". It is not a binary judgement but the more you abuse the "fairness" of the system the less you will be accepted as a "winner" not just by a group people lumped together under the prejudicial heading "London centric political elite" but by everyone including many of those on the winning side.

It was a snapshot of the country’s feeling almost 3 years ago. Let’s have another, I say, to check that is still the case before we do something really stupid that can’t be undone.

HootyMcOwlface I endorse your view. What does anyone have to fear? I agree another check would give us a far clearer view on what the people truly think three years on, in light of all the new information that has been released. Could some people have vested interest in making a huge profit from leaving? They seem so hell-bent on casting us adrift from our biggest market and closest allies. It doesn't make any sense.

The BBC has a lot to answer for.

I’ve been pottering through the BBC charter and it appears to me that they are playing fast and lose with it. It seems that there are vested interests happy to see this happen.

We now know that Leave U.K. actively courted fascists knowing that their message would appeal to the extreme right.

We now need to know about their latest manifestation the Brexit party.

There were plenty of empty chairs at the launch but there are huge influx of cash and a private jet for Farage.

It has no policies, it’s MEPs are multi billionaires and disaster capitalists.

But the turkeys will still be voting,and the multi millionaires know it waiting for the massive windfall that will surely fall into their already overloaded coffers.

The UK is among some 60 countries signed up to the "Code of good practice on referendums" drawn up by the Venice Commission in 2006.

A common safeguard is a two stage referendum - first an advisory vote, then if that advocates change it is followed with a detailed proposal to be the subject of a second vote either by parliament or the people.

The law governing the 2016 referendum was established when the European Referendum Act 2015 was passed by parliament. This specified that the referendum would be ADVISORY. Any votes in parliament should be free, not under the force of party whips.

It is time for this to be clearly explained to the public. Let us hope that we can have a second vote which is conducted fairly, without foreign interference, lies and deception or illegal overspending which we now know tainted the first vote.

All this about the leave campaign is ridiculous, it's all been over and done with, the money was paid back. Funny you don't post anything about David Camerson sending millions of leaflets out to the whole country to get us to remain and this cost 9 MILLION!!! of OUR money!!
Stop moaning about Brexit remainers you lost - get over it.

Leave got away with lying about money for the NHS, visas for Commonwealth citizens and much more, but now the truth about the Brexit deal is emerging, they won’t be able to lie anymore.

No way has this been resolved. It has been proved that if the referendum had been mandatory it would have been declared annulled because of the lying, cheating and foreign interference. The only reason this has not happened is because it was only advisory.

A crowdfunded legal case against Boris Johnson for allegedly abusing public trust during the EU referendum campaign is to receive a hearing in court later this month.

Private prosecutor Marcus Ball alleges that the former foreign secretary committed three offences of misconduct in public office by endorsing and making statements which he knew to be false at a time when he was mayor of London and an MP.

The allegation relates to the much-trumpeted claim by the Vote Leave campaign that the UK sends £350 million a week to the European Union, which was found to be misleading by the UK Statistics Authority.

Mr Ball said: "This case is a world first, it has never happened before. A Member of Parliament has never been prosecuted for misconduct in public office based upon alleged lying to the public.

"My backers and I aspire to set a precedent in the UK common law making it illegal for an elected representative to lie to the public about financial matters."

The private prosecution is due to receive an initial hearing behind closed doors at Westminster Magistrates' Court on May 14.

It is not known whether the case will proceed to trial.

Mr Ball has raised more than £370,000 in crowdfunding campaigns to finance the case.

Very proud to have contributed to the cost - and really hope Johnson will see him officially punished. It is time politicians got the message that blatant lying in a campaign is WRONG and will have consequences.
