Apologies for my technical inability to link, maybe some one will.
This individual says they were confused from age 4 about gender identity. S/he has been taking hormones and told the court s/he wants ‘all the surgery the nhs can give’. Defence council argued there are three vulnerable women in the case, his client and the women. The defendant pleaded not guilt, arguing the sex was consensual. Both women gave evidence that they resisted, told him no but his strength overcame resistance. The jury clearly believe the women.
He’s ric to a women’s prison, but will be kept in solitude.
We need prison facilities for these kind of offenders. I understand they’d be vulnerable in men’s prisons but they should not be in women’s prison.

Not with a penis, as only men have them.

That wasn't the statement. The statement was that women couldn't commit rape.

?????????

No, in the legal definition of the word as the law stands at the moment.

I think I know what you mean, Gagajo but that would not constitute rape.

They can't.

Here is the legal definition, from the Met. Note the words 'With a penis', which excludes women.

Rape and sexual assault

All rape and sexual assault is serious. The terms rape and 'sexual assault' are used simply to differentiate between two types of offence. So what's the difference?

The legal definition of rape is when a person intentionally penetrates another's vagina, anus or mouth with a penis, without the other person's consent. Assault by penetration is when a person penetrates another person's vagina or anus with any part of the body other than a penis, or by using an object, without the person's consent.

The overall definition of sexual or indecent assault is an act of physical, psychological and emotional violation in the form of a sexual act, inflicted on someone without their consent. It can involve forcing or manipulating someone to witness or participate in any sexual acts.

Not all cases of sexual assault involve violence, cause physical injury or leave visible marks. Sexual assault can cause severe distress, emotional harm and injuries which can't be seen – all of which can take a long time to recover from. This is why we use the term 'assault', and treat reports just as seriously as those of violent, physical attacks.

Not as defined by U.K. law

Thank you Doodledog for the legal definition. Memory tells me this isn’t the first time the statement ‘women can’t rape’ has been challenged.
Anyone who has personal or professional experience of the devastating impact on women of male rape would surely find it impossible to take an intellectually superior position

Exactly grannygravy

All prisons should ensure the safety of all prisoners. This would cost a lot of money. Maintaining human rights does cost money.

wants all the surgery then nhs can give

What a cheek with the present situation the NHS is in

MerylStreep Wed 25-Jan-23 20:30:13

JaneJudge

how has the rights of one male criminal who is transitioning after his rapes of several females trumped the safety of all the women prisoners to wherever he is being sent? Safeguarding is being ignored

Because the tail is now wagging the dog in nearly all areas of our society.
If it wasn’t so bloody awful it could almost be as funny as the life of Brian scene where Stan wants a baby.

I wonder how female prison officers feel about having men like this one in their prisons. He still has a male body and male physical strength. There are occasions when body searches are made.

TerriBull Thu 26-Jan-23 08:43:03

What I find pretty perplexing in a minor way amongst the myriad of far more perplexing issues surrounding this case, not least the prosecutor in a court of law referring to the accused's genitalia as "her penis" is this. Isla out and about parading their new persona, going the full girly pink, pink pixie hooded jacket, pink wheelie case, how we girls love our pink paraphernalia hmm Incongruously amongst all the pink shit female stereotypical accoutrements, is ahem, the clearly visible bulge in the skin tight leggings. Which begs the question if one wants to present as a woman, why is that on display, or is there also some autogynephilia going on there as well hmm

‘Her’ ex wife is saying it’s all ‘a sham’ to get attention and an easier time in jail

TerriBull - the display of his male penis through skin tight leggings was clearly deliberate. Red Flag

Galaxy Thu 26-Jan-23 08:59:12

Yes absolutely. Do people have no understanding of offending behaviour.
It reminds me of the minimising of offenses such as flashing.

MawtheMerrier Thu 26-Jan-23 09:00:35

Oh and there I was thinking he’d got an unusual pocket for his ciggies and his lippy.
(Do wonder how he pulls his tights up with those nails!)

The irony is, despite (or perhaps because of) all the pink etc he looks less feminine than Danny la Rue or Lily Savage on a bad day.

sodapop Thu 26-Jan-23 09:01:54

Absolutely agree with JaneJudge the rights of one person should not outweigh the safety of many others.
Unbelievable.

I don’t even think that he’s an agp.

I have just read the transcript so I need to go back and listen but Yvette cooper is on radio 4 saying no to female prison for this rapist.

Iam64 Thu 26-Jan-23 09:31:38

Thanks Galaxy I’d missed Yvette cooper.
