Chicken nuggets……..strugglin g to believe this!

So allegedly a judge has ruled an Albanian criminal has the right to stay in the UK because of his 10 year old son’s dislike of foreign food, in particular chicken nuggets!

The son does not speak any English and apparently does not officially have any special needs.

I have no words.

I just weary of these supposedly "shock horror" O/P's that take a little chunk of a media "shock horror" story when a little checking would reveal the issue was/is actually quite complicated, as if any case like this really hung on chicken nuggets.

Klevis Disha was a UK citizen and his children of course also are.

Had he not gained citizenship by deception he would not have been subject to deportation.

So it makes it much more complicated in terms of our "deport foreign criminals on release" policy.

First is the stripping of UK citizenship due to deception, and then there is the Right to a Family Life decision.

It's got into a right mess by the sound of it. Probably because of because of the crucial issues of deception in gaining citizenship.

Has that definitely happened, has he been stripped of citizenship?

Personally I think its safe for them all to return to Albania, but I'm not surprised this particular case has descended into muddy waters.

The child's dislike of 'foreign' nuggest was one of the arguments presented to the court that influenced the decision to allow an Alabanian wanted for murder in Albania to remian in the United Kingdom. How much weight the nugget argument was given by the court is not possible for us to determine. Unless and until this country finds the stones to quit the ECHR, or unless and until the ECHR us revised, this nonsense will keep on happening.

Gransnet posters are quite rightly shocked at the lies, deception and criminality involved in the case of Klevis Dishna and his gift of UK citizenship, which has rightly been rescinded; would you expect it to be otherwise?

The boy's claim to continue to reside here, (which would entail his father, a convicted criminal, also continuing to live here )was based purely on his dislike of foreign food, which does not constitute special needs provision. Should that be prioritised over the many cases for genuine special needs support?

The lawyer representing the person avoiding deportation will put together a whole raft of reasons, good,bad and frivolous as to why someone cannot be deported and the judge will make their decision based on the substantive reasons.

Journalists will, of course, concentrate on the reasons that make a good story. Hence, when someone is given the right to remain in the UK, if a journalist sees among the reasons they listed for not being deported something frivolous, they will concentrate on that, even though that may well not be the reason the right to remain was given

One rather assumes that most people have the intelligence to see that no one would be given a right to remain only because they have a cat, or because their child will not eat foreign chicken nuggets. The child may well be severely autistic or learning disabled, hence the fussy eating. or the right might have been given for other mors substantial reasons.

The case is going to be reheard MOnica, as the government appealed the decision and a more senior judge agreed that it was unsatisfactory. As the father was due for deportation after serving a prison sentence here, and is wanted for murder in Albania, and there has been no formal diagnosis of the child’s alleged special needs, including food preferences, I hope the decision will be reversed.

As said, I am sure the children's special need was just one of several more substantial reasons for appealing the deportation order, and not one that was likely to be key to the decision.

I am not defending or attacking the legal decision, merely pointing out that there will be a list of reasons why the man's legal advisors will be fighting the deportation order, most of them far more substantive, but the press will always focus on the frivolous or more ludicrous reason given, at the expense of the much more substantive reasons on which the decision is actually made.

the article suggests he is awaiting a formal diagnosis though -
presumably if his dad is going to prison in Albania it would be better for the lad to be fostered here?

The child’s alleged special needs, not diagnosed but apparently including a dislike of foreign food, seem to have been central to the judge’s decision to allow the appeal against deportation but a more senior judge considered it was wrong to say such needs couldn’t be met in Albania. The child also has a mother, so no need for fostering.

Where has the Mother been mentioned?
I thought they were suggesting ARFID, which is common in ASD. I am unaware of diagnosis complications in Albania or acceptance. It may just highlight the difficulties rather than it just being about chicken nuggets
