Not necessarily. The ruling merely said it was unconstutional. It did not say that the Queen was misled or that it was intended to thwart opposition.

Parliament could just resume as if nothing has happened and BJ will remain PM. It has been suggested that he could prorogue again, but the ruling states that 4 6 days is the conventional period of prorogation to prepare for the Queens speech, so I think if BJ did choose to prorogue again, he would face another challenge in the courts if it exceeded that period and, although I am not a lawyer, I would hazard a guess that it would be possible to get a court injunction so that the proroguation could be instantly suspended, pending a full argued appeal before the Supreme Court (again)

You could say that the Queen should have come down off the fence and used her own judgement.

I suppose I’d have just said that Boris isn’t a lawyer. He will have taken legal advice before prorogation. And bear in mind, the English judges agreed with him originally.

What he did wasn’t illegal.

He should go, as he has abused parliament and misled the Queen. He has been told very clearly not by the local magistrate, but by the Supreme Court of these islands that he is not above the law. Anyone with a sense of honour would resign after such a damming ruling against them.

Why wouldn't other criminals coming before a court expect to be simply allowed to carry on as though nothing had changed, when we have a PM who breaks the law and may seek to carry on as though nothing is amiss? He should be removed from office.

Monica look at Par. 61 of the judgement I think it says exactly that.

The court unanimously declared "the Prime Minister's advice to Her Majesty was unlawful, void and of no effect" when he asked the Queen to suspend parliament
The decision "had the effect of frustrating or preventing" parliament from carrying out its functions, it said, and was like "a blank sheet of paper ".

I imagine he would have taken legal advice from the Attorney General. I can't wait for their to be a general election and I honestly believe Boris will win the next election with lager margin. He should not resign as under Boris the Conservatives are going up in approval rating in UK and they are currently consistently on 37% in opinion polls. That is higher than under May. The tide is turning and people are getting fed up at not leaving EU. Fed up with MP's who's constituency voted to leave but MP's who were elected to represent their constituents ignoring them.

If opposition parties really disagreed with Boris' decision to then they should have called a vote of no confidence in him.

So what will happen to the original judges who apparently made the wrong call in declaring the prorogation WAS legal? Maybe we should just have another appeal because who's to say the latest ruling was correct? As well as losing faith in government and parliament I'm now losing faith in the judiciary

Great news today from the Supreme Court that Parliamentary democracy must be respected.

Who knows what happens next but Prime Minister Johnson currently looks like a dishonourable fool. His actions have unanimously been pronounced unlawful.

I have no faith in Jeremy Corbyn or the Labour Party, but perhaps collectively, the Tory rogue 21, the Lib Dems, Greens, Plaid Cymru, the Scot Nat's & Labour can find a plan.

This is unprecedented, a unanimous judgment against the government, Johnson should not resign he must be made to remain and sort out the mess he started.

orly the original court did not rule the prorogation legal, they said it wasn't justiciable (subject to the courts), but a political matter. They did not examine the evidence. The supreme court ruled it was justiciable, and then went on to consider all the evidence before coming to their conclusion.

I’m amazed that others are not accepting the judgment. Lower courts often have a different view, this time the previous judgment missed out the Appeal Court and went straight to the Supreme Court where 11 judges unanimously ruled against the Government.

This just shows how unreasonable Brexit supporters are, the referendum was only won by voters believing the lies they were told by guess who, Boris, JRM and the other liars.
