has anyone made an application to an employment tribunal? Do you know if applications are usually accepted as long as the grounds are reasonable. Do we put just basic outline on the initial application or do we have to give the full story and supporting evidence? many thanks

seasider sorry you lost, good luck to you and your DH for the future, you can move on now knowing you left no stone un-turned flowers

I'm shocked to hear this result Seasider. They offered you settlements and they knew you had a case. I'm so sorry it has turned out like this and like others have said, I hope it is consolation that you have kept your integrity and played it straight down the middle. All my very best wishes for you and your husband - you deserve a little peace now. The thought of having this awful time behind you will help flowers

So sorry to hear your news.

Yesterday was a very long and intense day. the other side brought a barrister depite the fact we were unrepresented. It soon became clear there had been a number of dirty tricks in respect of the evidence that I suspect had been done to may things more difficult for us. The judge did say that whilst she may think that DP's dismisssal was harsh the employer had followed proper procedures. ( we would still disagree) . The two instigators were not there and both the disciplining and appeal officer had failed to even speak to them relying solely on written statements!.

The hearing lasted all day and the barrister did ask us to have our diary handy in case of another hearing to discuss the financial part so I think he was unsure of the outcome!

After hearing the way his ex-managers spoke and the descriptions of the situation at work DP now feels he is better off away from there though he did love his job.

We were pretty down last night and when I saw all your messages of support it made me cry ( did feel better as had been holding it in all evening) Thank you all so so much for the advice and support. We are having a few days away next week with no mention of work! xx smile

We had a lovely break but we still feel decision unfair so have today asked the tribual to consider a review of the decision!

whenim64 Tue 26-Jun-12 14:07:40

I'm glad to hear you have come to this decision, Seasider. I felt we shouldn't suggest it as you really had gone through the mill and might have wanted to put it behind you, and I wouldn't blame you! X

Annobel Tue 26-Jun-12 14:33:00

Good for you, seasider. It did seem to be an inexplicably perverse decision. We are all behind you.

gracesmum Tue 26-Jun-12 16:15:25

You have nothing to lose by asking for a review do you? I think it is very brave of you after such an unpleasant experience, but give it a go!

jeni Tue 26-Jun-12 17:06:12

If it is 'perverse' that is a reason to set aside!

seasider Tue 03-Jul-12 23:31:42

Hi all . The review has been refused but I don't suppose any judge is going to overturn their own decision!. They have agreed to provide a full statement of reasons for the original decision so we then have to see if we have grounds for an appeal. On a positive note Dp's new job is physically taxing and poorly paid but I think he is quite enjoying the lack of responsibility. It has also made him realise just how bad the atmosphere was at his previous place of employment and the stress everyone was under. Thanks again for all your support smile

whenim64 Wed 04-Jul-12 07:32:37

Good to hear that you are being pro-active Seasider. smile

merlotgran Wed 04-Jul-12 09:33:59

Don't put yourselves under any more stress, seasider. Accept and move on. Some things are meant to be and your DP sounds like he's enjoying his new job. When my DH was made redundant from farm management he went lorry driving for a few years to take him up to retirement. He loved the lack of responsibility even though the money wasn't good and it meant I had to carry on working past retirement age. We got here in the end though. smile

seasider Thu 05-Jul-12 14:05:30

I wish I could Merlotgran I would love to walk away but I hate unfairness and I truly believe DP was forced out. It is a case of an individual against a national company and I feel we must persue it as far as we can for ourselves and future employees who may be treated as badly. The company concerned promotes themself as a hapy clappy family friendly company . If only people knew the underhand practices that go on! Thanks for your concernx

seasider Wed 29-Aug-12 17:08:23

I am sure there are those who will think we are mad to carry on but I have today submitted our appeal to the Employment Tribunal. I just feel we have to try. On a positive note DP, who is actually enjoying his current( no responsibility) job, has got another slightly more permanent post wich will take him through to next year. smile

annodomini Wed 29-Aug-12 17:20:21

Well done, seasider. The original decision sounded decidedly unfair. Good luck to you and your DP. I'm glad he has a job and prospect of more work.

seasider Tue 04-Sept-12 00:02:35

thank you Annodomini. Our application was acknowledged the following day so now we just have to wait and see. Will let everyone know the outcome

whenim64 Tue 04-Sept-12 00:04:03

Good luck seasider. You deserve a break now, and a more sympathetic ear for your case. smile

Greatnan Tue 04-Sept-12 05:25:17

Good luck, seasider. You are not the only member fighting a large organisation and it is truly a daunting process.

seasider Fri 28-Dec-12 20:26:02

to anyone following our employment tribunal saga we have now been granted an oral hearing in London on 1st May 2013 . Hopeully this judge will be able to see how badly DP was treated and how he was set up by his manager. I think this is as far as we can go but whatever the outcome at least we will have explored all the options .

Ana Fri 28-Dec-12 20:31:06

I've been following your story, seasider, and am impressed by your perseverance! Most would have given up long ago - I do hope you get the result you want from the hearing, you and your DP certainly deserve it.

bluebell Fri 28-Dec-12 20:39:45

Absolutely agree Ana

whenim64 Fri 28-Dec-12 20:39:48

That's good news Seasider. Perhaps you'll get a better hearing this time smile
